BUDGEWOI DUNE CARE – KILLING THE BUSH ???

Police arrived at an Erudgeree St home yesterday morning (Saturday 4 April 2009), guns ablaze like normal, accusations flying and armed with an attitude you'd expect from a con.

Police officers smashed on the front unit of the home for at least 10 minutes waking up every neighbour in the area on a lovely and what was quiet Saturday morning in the beachside suburb absolutely demanding that the person in question "Get Down Here Now".

When officers wonder why they are completely ignored these days and people are now putting up signs on their property and locking their gates to their backyards, here's a damn good example of poor police behaviour self explaining why.

The officer was actually investigating a complaint made by another close resident that the person in question had poisoned their lawn. Due to the nasty nature these days of the police, the person in question refused to talk to them, as last time she did on another matter they arrested her, referred to her in their statements as a jobless drug addict incapable of looking after her daughter, and then dragged her through the court system for 5 months, only to have the matter thrown out as the person in question had not done anything wrong in the first place.

This person in fact, is me, and in reference now to the abovementioned matter i would like to state the following facts and supply this information to both the NSW Police for their investigation, seen as how they're extremely quick to jump gun at any chance to give me a difficult time:

ABOUT THE COMPLAINANT:

  1. The officer has stated that the complainant is a member of dune care, and as such,
  2. The complainant states she has the right to use of chemicals in the bushland in the surrounding area.
  3. The complainant admits to the officer that she uses poisons in our bush.
  4. The complainant (resident of 1 Uwa Street Budgewoi) has been using poisons in the bush for at least 3 years that I have seen and am aware of.

LEGISLATION REGARDING THE LOCAL BUSHLAND:

Regulation 23 Part 2 (listed below) states:

"A person shall not:

(a) prune or trim (except in accordance with AS 4373-1996, Pruning of amenity trees ), remove, clear, cut down, destroy, poison, ringbark, lop, top, injure or interfere with any tree or native vegetation without the prior development consent of the Council, or

(b) cause, permit or authorise the pruning or trimming (except in accordance with AS 4373-1996, Pruning of amenity trees ), removing, clearing, cutting down, destroying, poisoning, ringbarking, lopping, topping, injuring or interfering with of any tree or native vegetation without the prior development consent of the Council. "

QUESTION TO COMPLAINANT:

  1. What such evidence do you have to secure your statements about working for dune care?
  2. Where is the appropriate development consent required by council for the below for each and every poisoned native tree (shown in pictures below) at the Uwa Street beach entrance, which you have been photographed and viewed by local residents, and which you freely admit to using poison on to the NSW Police?

QUESTION TO BE ANSWERED BY NSW POLICE OFFICERS INVOLVED IN POISONING INVESTIGATION:

  1. What valid evidence did you obtain to ascertain that the complainant actually does work for Dune Care and is not posing as a Dune Care worker to justify her use of poisons in the bush?
  2. What paperwork did you view to ascertain that the complainant has the appropriate permissions / authorities by the local council to be in the bush using admitted poison?
  3. When were you advised by the complainant about her use of poisons in the local bush?
  4. When you were advised by the resident you spoke to that the complainant was constantly using poison in the bush, did you take even one moment to walk up the beach track and investigate the complaint being made?, and
  5. Did you even take note of how many native bushes were in the process of dying, as this is both a state and federal matter, given that you were freely given admission of use of poison within the local bush by the complainant?

QUESTIONS TO BE ANSWERED BY DUNE CARE:

  1. Does the complainant work for Dune Care?
  2. Where is the appropriate paperwork (development consents) with council approval for the poisoning of all native bush shown in pictures 1 to 30 below?

WHAT APPROPRIATE MEASURES HAVE BEEN TAKEN BY THE PERSON IN QUESTION TO ENSURE THAT THE COMPLAINANT CEASES ALL UNAUTHORISED USE OF POISONS AND DESTRUCTION AND REMOVAL OF TREES IN THE LOCAL BUSH AREA:

  1. Prior to November 2008 the person in question had a very polite conversation with the complainant and advised the complainant that she in fact was killing a lot of native bush.
  2. Prior to November 2008 the complainant was also advised that the use of poison was not authorised and that she should cease all use immediately to avoid further investigation into the matter.
  3. Prior to November 2008 the complainant was also advised that there is an abundance of wildlife within the area that she is poisoning that rely on the foods on the forest ground – and with her poisoning such areas would be detrimental to native wildlife.
  4. January 2009 the complainant was advised a little more abruptly that the council had been informed of the poisons being used by her, photographs were being taken of her applying the poison and photos of plants being poisoned for evidence were also taken.
  5. March 2009 the complainant was instructed by virtual speaker phone to get out of the bush with her poison, to stop poisoning her bush, that the police were going to be informed, that all the neighbours were now well aware that she is responsible for the destruction of our beach entrance bush area.

WHAT NATIVE WILDLIFE EXIST IN THE AREA BEING POISONED BY THE COMPLAINANT THAT USE THE FOREST FLOOR TO SCOURAGE AND FEED (THAT I MYSELF HAVE SEEN)?

  1. Echidna families (unbelievable, and until 6 months ago, I never had a clue)
  2. Willy Wag-Tail families
  3. A huge big eagle-like bird that is not carnivorous
  4. Native rats
  5. Lizards / skinks
  6. Native / protected snakes

OTHER POINTS OF INTEREST SURROUNDING THE POISONING OF THE NATIVE BUSH IN UWA STREET BY THE COMPLAINANT:

  1. There is becoming a very clear line in between the complainants home and Bird Island with the destruction of the bush. The complainant is being very clever just taking out a plant here and a plant there but a blind man can see that they're poisoning for the views.
  2. With the excessive amount of chemical use on the area the native ground cover has not been able to establish itself along the path for over 12 months now, with no end in sight to the poison being laid.
  3. There seems to be no help in sight for the destruction of all the beautiful wattle plants being poisoned by the complainant and a good look at the whole area shows both the already completely dead wattle bush and the "in the process of being totally poisoned" wattle bush.
  4. There is no possible excuse or legitimate reason to justify the killing of all the native plants that are being wiped out by the complainant, nor would any council worker in their right mind sign paperwork for the destruction of the said plants.
  5. The only person that uses the poison involved in the investigation is the complainant.
  6. As soon as it was clear that the person in question was not giving up on the destruction of the bush without council development consent in Uwa Street, the complainant rang the police and accused the person in question of poisoning the complainants lawn.

ABOUT THE PERSON IN QUESTION

  1. The person in question is the owner / operator of a well known not-for-profit community service that works to both help the community providing various community services, and for the betterment of the government.
  2. The person in question was supplied the personal phone numbers of the complainants by the complainants last year, after offering to assist them with their continual break-ins in their Uwa Street residence.
  3. The person in question assisted Toukley police last year in apprehending a sex offender on beach exposing himself and being a public menace, and then was not unreluctant to participate in court proceedings if required further down the track.
  4. The person in question was an avid sponsor of the Police Down Under magazine published by Border Publications which supports the NSW Police.
  5. The person in question also provides meals to an ex-war veteran in her neighbourhood on a regular basis (3 to 4 evening meals per week) as nothing more than a (non-business related) community service, her reason being "Well, he served us, so now this is my opportunity to serve him".
  6. Whilst the the person in question has no interest due to disbelief in Dune Care's inability to control the killing of the native plants, she does assists in the care of the dunes, by regular litter patrol.
  7. The person in question regularly monitors youth activity in the neighbourhood and her ability to interact with such crowds quite often enables the neighbourhood to have a peaceful sleep, as police presence in the area is quite poor.
